Chapter One: Introduction

Welcome to the Alo Farmer application, owned and operated by Nawas Company (the “Company”).

The Alo Farmer application is an electronic platform designed to connect customers with agricultural service providers within the Kingdom of Saudi Arabia in a safe and convenient manner, with the aim of improving the user experience and enhancing the quality of agricultural services provided to individuals and establishments.

The services offered through the Platform include, without limitation, landscaping, tree planting, tree pruning, palm tree planting, grass cutting, irrigation systems, pest control, fertilisation, garden cleaning, removal of agricultural waste, and any other agricultural services that may be added by the Company in the future.

By accessing, registering with, or using any of the services provided through the Application, the User expressly and irrevocably agrees to comply with these Terms and Conditions, the Privacy Policy, and all other policies and guidelines related to the Application.

If the User does not agree to any provision of these Terms and Conditions, the User must immediately cease using the Application.

Chapter Two: Definitions

Company

Nawas Company, the owner, developer, and operator of the Alo Mazaree application.

Application

The Alo Mazaree electronic platform in all its versions, whether accessed through mobile applications, the website, or any other digital platforms approved by the Company.

User

Any person who uses the Application, whether as a visitor, Customer, or Service Provider.

Customer

Any natural or legal person who requests an agricultural service through the Application.

Service Provider

Any individual, establishment, or company registered on the Application for the purpose of providing agricultural services to Customers.

Service

Any service displayed, offered, or requested through the Application.

Request

The process of requesting a Service through the Application, commencing when the Request is submitted and ending when the Service is completed or cancelled.

Commission

The amount payable to the Company for the use of the Platform, in accordance with the announced percentage or applicable fees.

Account

The electronic account created for the User within the Application.

Content

All texts, images, logos, graphics, icons, software, and data contained within the Application.

Payment Methods

All electronic or other payment methods approved by the Company.

Policy

Any policy, regulation, or instruction issued by the Company in connection with the use of the Application.

Chapter Three: Eligibility to Use the Application

The User must have full legal capacity to enter into contracts in accordance with the applicable laws and regulations of the Kingdom of Saudi Arabia.

If the User is below the legal age, the Application must be used under the supervision and with the consent of the User’s parent, legal guardian, or other legally authorised representative.

The User must provide accurate, complete, and up-to-date information when registering.

The User shall bear full responsibility for the accuracy of the information provided.

The Company may request any documents or information required to verify the User’s identity at any time.

The Company may refuse to create, suspend, or delete an Account if the User is found to have provided inaccurate, misleading, or forged information.

The User must not create more than one Account for the purpose of circumventing the Application’s rules or misusing the Application.

The User acknowledges that they are solely responsible for all transactions and activities carried out through their Account.

The User must maintain the confidentiality of their username, password, and verification code and must not disclose them to any other person.

The Company shall not be liable for any transactions carried out using the User’s login credentials.

Chapter Four: Account Creation

Any User may create an Account on the Application in accordance with the approved registration procedures.

The Company may require verification of the User’s mobile number, email address, national identity document, or any other supporting documents.

The Company may suspend the Account until the verification procedures have been completed.

The User must update their information whenever any changes occur.

The Company may cancel Accounts that have remained inactive for an extended period after notifying the User, where appropriate, in accordance with the Company’s internal policy.

The Account may not be sold, leased, assigned, transferred, or made available for use by any other person without the Company’s approval.

Chapter Five: Use of the Application

The User shall:

Use the Application solely for lawful purposes.

Refrain from using the Application for any activity that violates applicable laws, regulations, or public morals.

Refrain from attempting to hack, disrupt, disable, or compromise the security of the Application.

Refrain from publishing any misleading, offensive, or unlawful information or content.

Refrain from using the Application to harm any other User.

Refrain from using automated tools, software, or programmes to extract data or copy Content without the Company’s approval.

Refrain from impersonating any individual or entity.

Comply with all instructions and policies issued by the Company.

Refrain from using the Application in any manner that may adversely affect the performance of the Platform or the rights of other Users.

The Company reserves the right to take any appropriate action, including suspending or terminating the Account, in the event of any breach of these Terms and Conditions.

Chapter Six: Services Provided Through the Application

Article (6): Scope of Services

The services offered through the Application may include:

Landscaping.

Planting trees and shrubs.

Planting and relocating palm trees.

Tree pruning.

Grass cutting.

Installation and maintenance of irrigation systems.

Installation and extension of irrigation networks.

Fertilisation and soil improvement.

Pest and insect control.

Cleaning gardens and farms.

Removal of agricultural waste.

Supply of plants and seedlings.

Maintenance of green areas.

Garden design.

Any other services that may be added by the Company in the future.

Article (7): Nature of the Service

The Application operates as an electronic platform that connects Customers with Service Providers.

The Company is not a direct party to the performance of the Service.

The Service Provider shall be responsible for performing the Service in accordance with applicable laws and the agreement entered into with the Customer.

The Company may intervene to assist in resolving disputes in accordance with its internal policies.

Article (8): Availability of Services

The availability of Services may vary depending on the city and region.

Certain Services may not be available in all locations.

The Company reserves the right to add or discontinue any Service without prior notice.

Certain Services may be suspended for operational or regulatory reasons.

Chapter Seven: Service Requests

Article (9): Creating a Request

To create a Request, the Customer may be required to:

Select the type of Service.

Specify the location.

Select the date.

Select the time.

Provide a description of the issue or requested work.

Upload photographs, where required.

Submit the Request.

Article (10): Acceptance of the Request

The Request shall be sent to an appropriate Service Provider.

The Service Provider may accept or reject the Request.

The Request shall not be considered confirmed until it has been accepted.

More than one Service Provider may be nominated depending on the nature of the Request.

Article (11): Amendment of the Request

The Customer may amend the Request before it is accepted by the Service Provider. Certain information may also be amended after acceptance, subject to the features and permissions made available through the Platform.

Article (12): Performance of the Service

The Service Provider shall:

Attend at the scheduled time.

Perform the Service in accordance with the description provided.

Use appropriate tools and equipment.

Protect the Customer’s property.

Comply with all applicable laws, regulations, and instructions.

Article (13): Closing the Request

A Request may be closed upon:

Completion of the Service.

Cancellation of the Request.

Expiry of the Request period.

Mutual agreement between the parties to close the Request.

Termination of the Request by the Company due to a violation.

Chapter Eight: Prices and Payment

Article (14): Prices

Prices may vary depending on the type of Service.

Prices may vary depending on the region.

Prices may vary depending on the Service Provider.

The cost shall be displayed before confirmation of the Request whenever reasonably possible.

Prices may include applicable taxes and statutory fees, where relevant.

Article (15): Payment Methods

The Application may support the following Payment Methods:

mada.

Apple Pay.

Visa.

Mastercard.

STC Pay.

Bank transfer, where made available by the Platform.

Any other payment methods approved by the Company.

Article (16): Platform Commission

The Company shall be entitled to receive a Commission for the use of the Platform, in accordance with the announced percentage or applicable fees.

The Company may amend the Commission in the future after notifying Users.

Additional fees associated with payment methods or optional services may be charged, provided that such fees are disclosed before completion of the transaction.

Article (17): Invoices

The Company may issue an electronic invoice containing the details of the Request and the amounts payable, in accordance with applicable laws and regulations.

Chapter Nine: Cancellation and Refunds

Article (18): Cancellation by the Customer

The Customer may cancel the Request before it is accepted by the Service Provider without incurring a fee, unless a specific policy provides otherwise.

Article (19): Cancellation After Acceptance of the Request

If the Request is cancelled after it has been accepted by the Service Provider or after performance has commenced, a cancellation fee may apply, or a portion of the Request value may be deducted in accordance with the Platform’s policy.

Article (20): Customer No-Show

If the Customer is not present at the scheduled time or cannot be contacted, the Request may be treated as cancelled, and an appropriate fee may apply in accordance with the approved policy.

Article (21): Service Provider No-Show

If the Service Provider is delayed or fails to attend without an acceptable justification, the Platform may reschedule or cancel the Request or take any other appropriate action against the Service Provider.

Article (22): Refunds

Any amounts eligible for refund shall be returned to the original Payment Method or through any other method approved by the Company, within the period specified in the applicable payment and refund policy.

Chapter Ten: Ratings and Reviews

Article (23): Right to Submit a Rating

The Customer and the Service Provider may rate each other after completion of the Request.

Article (24): Rating Requirements

A rating or review must:

Be based on an actual experience.

Avoid offensive statements, defamation, or personal abuse.

Not contain misleading or inaccurate information.

Article (25): Management of Ratings

The Company may delete or hide any rating or review that violates applicable laws or contains offensive, abusive, or misleading information.

The Company may also use ratings and reviews to improve the quality of Services and to classify or rank Service Providers.

Chapter Eleven: Customer Obligations

Article (26): General Obligations

The Customer shall:

Use the Application solely for lawful purposes.

Provide accurate, correct, and up-to-date information when creating an Account or requesting a Service.

Maintain the confidentiality of login credentials and refrain from sharing them with any other person.

Comply with all laws, regulations, and instructions issued in the Kingdom of Saudi Arabia.

Refrain from any conduct that may damage the reputation of the Application, Service Providers, or other Users.

Article (27): Obligations During Performance of the Service

The Customer shall:

Provide an accurate and clear address for the location where the Service is to be performed.

Ensure that the Service Provider can easily access the location.

Provide a safe working environment free from unusual risks.

Disclose any circumstances that may affect the performance of the Service before work begins.

Cooperate with the Service Provider throughout the performance period.

Article (28): Prohibited Conduct

The Customer must not:

Reach an agreement with the Service Provider outside the Application for the purpose of avoiding the Platform’s Commission.

Submit malicious or vexatious reports or complaints.

Use offensive language, threaten, harass, or abuse Service Providers.

Publish the personal data of others without their consent.

Misuse the ratings and reviews system.

Use the Application for activities that violate applicable laws, regulations, or public morals.

The Company may take any appropriate action, including suspending or terminating the Account, where any of the above violations has been established.

Chapter Twelve: Service Provider Obligations

Article (29): Professional Obligations

The Service Provider shall:

Perform the Service professionally and efficiently in accordance with recognised technical standards.

Comply with the agreed appointment times.

Use suitable and properly functioning equipment and tools.

Maintain the cleanliness of the worksite after completing the Service.

Respect the Customer’s privacy and property.

Comply with all laws, regulations, licences, and legal requirements applicable to the performance of the relevant activity.

Article (30): Service Quality

The Service must:

Correspond to the advertised description.

Be performed in accordance with professional best practices.

Be free from gross negligence or defective performance.

Comply with applicable health, safety, and environmental requirements, where relevant.

Article (31): Professional Conduct

The Service Provider shall:

Treat Customers respectfully and professionally.

Maintain an appropriate appearance.

Refrain from requesting additional payments outside the Application without the Customer’s approval and except in accordance with the Platform’s policies.

Refrain from exploiting Customer data for any personal or commercial purpose.

Chapter Thirteen: Intellectual Property

Article (32): Intellectual Property Rights

The Company’s intellectual property includes, without limitation:

The Alo Mazaree name.

The logo and trademarks.

The visual identity.

Designs and user interfaces.

Software.

Databases.

Images and graphics.

Text and Content.

Marketing materials.

No part of the foregoing may be copied, reproduced, modified, or distributed without the Company’s prior written approval.

Article (33): Use of the Trademark

No User may use the Alo Mazaree name, logo, or any trademark owned by the Company in any advertisement, publication, or commercial material without the Company’s prior written approval.

Chapter Fourteen: Limitation of Liability

Article (34): Role of the Platform

The User acknowledges that the Alo Mazaree application operates as an electronic platform that facilitates connections between Customers and Service Providers and is not a direct party to the performance of the Service, unless expressly stated otherwise.

Article (35): Responsibility for Performance

The Service Provider shall be responsible for the quality and proper performance of the Service and for compliance with all relevant laws and regulations.

The Platform shall provide appropriate channels for receiving and reviewing complaints and taking any appropriate action in accordance with its internal policies.

Article (36): Disclaimer of Liability

The Company shall not be liable for losses, damages, delays, or issues arising from:

The provision of inaccurate information by the User.

Misuse of the Application.

Force majeure events.

Failures or interruptions beyond the Company’s control.

Agreements entered into outside the Application.

Any individual conduct by Users in violation of these Terms and Conditions.

Nothing in this Article shall exclude or limit any statutory liability that may not lawfully be excluded or limited under applicable laws and regulations.

Chapter Fifteen: Account Suspension and Termination

Article (37): Account Suspension

The Company may suspend an Account in the event of:

Unusual or suspicious activity.

Reports or allegations of fraud.

Use of the Application in violation of applicable laws or regulations.

Breach of these Terms and Conditions.

Article (38): Account Termination

The Company may terminate an Account in the event of:

Identity impersonation.

Forgery of documents.

Fraud.

Money laundering, terrorist financing, or any other activity prohibited by law.

Repeated violations.

Harm to the reputation of the Application or its Users.

The User may request closure of their Account, subject to the completion and settlement of any outstanding financial or contractual obligations before closure.

Chapter Sixteen: Force Majeure

Article (39)

The Company shall not be liable for any delay or inability to perform its obligations where such delay or inability results from circumstances beyond its reasonable control, including:

Natural disasters.

Floods.

Fires.

Epidemics or pandemics.

Wars or security disturbances.

Governmental decisions.

Widespread interruption of telecommunications, electricity, or internet services.

Any other circumstance considered a force majeure event under applicable laws and regulations.

Chapter Seventeen: General Provisions

Article (40): Amendments

The Company may amend these Terms and Conditions or any related policies at any time.

The User’s continued use of the Application after publication of the amendments shall constitute acceptance of such amendments, unless applicable laws and regulations require the User’s express consent in particular circumstances.

Article (41): Governing Law

These Terms and Conditions shall be governed by the laws and regulations of the Kingdom of Saudi Arabia.

The competent courts or judicial authorities within the Kingdom of Saudi Arabia shall have jurisdiction to hear and determine any dispute arising from or in connection with these Terms and Conditions, unless applicable law provides otherwise.

Article (42): Severability

If any provision of these Terms and Conditions is found to be invalid, unenforceable, or void by a court judgment or under any applicable law, the validity and enforceability of the remaining provisions shall not be affected.

Article (43): Contact Channels

Users may contact the Company through the official communication channels announced by the Company through the Application or its website for the purpose of submitting enquiries, complaints, or suggestions.

Article (44): Effective Date

These Terms and Conditions shall enter into force from the date of their publication within the Application and shall remain effective until amended or replaced by a more recent version.
